1. About These Terms
These Terms and Conditions govern your use of www.uniquetoyoucolour.ca (the “Site”) and the purchase or booking of products and services from Unique to You Colour. By using the Site or purchasing or booking through it, you agree to these Terms and Conditions, subject to any rights that cannot legally be excluded.
2. Products and Services
Unique to You Colour offers physical products, including cosmetics, colour swatch books, women’s accessories and scarves, and other home or lifestyle products, as well as in-person and online colour analysis services. Product descriptions, photographs, colours, availability, pricing, and other information are provided as accurately as reasonably possible, but colours shown on screens may vary.
3. Colour Analysis Services
Colour analysis services are provided as personal styling and colour guidance based on the information and circumstances available at the time of the consultation. Results and recommendations are professional guidance and are not a guarantee of any particular appearance, outcome, purchase decision, or personal result.
4. Online Colour Analysis
Online colour analysis relies on photographs and information supplied by the client. Results may be affected by lighting, camera settings, white balance, filters, makeup, hair colour, clothing, image quality, and the display or screen used to view photographs. Clients are responsible for providing photographs and information that are as accurate and suitable as reasonably possible. Photographs may be submitted with the questionnaire or, if not submitted at that time, by email to info@uniquetoyoucolour.ca.
5. Booking and Payment
Payment for products and services is due in accordance with the payment terms communicated to the client at the time of purchase or booking. Payment may be required at the time of purchase or booking, or at another time communicated by Unique to You Colour. Available payment methods may include PayPal and other payment methods made available through the Site.
6. Online Purchases and Bookings
Before completing an online purchase or booking, customers will be provided with applicable transaction information and an opportunity to review and correct errors before entering into the transaction. Where required by applicable law, Unique to You Colour will provide the customer with a written copy of the applicable agreement in a manner that allows the customer to retain and access it for future reference.
7. Appointment Scheduling and Performance
Appointments are provided at the date and time agreed with the client. Clients are responsible for attending at the scheduled time and, for online services, providing the required information and photographs in a timely manner. Unique to You Colour may need to reschedule an appointment in circumstances beyond its reasonable control and will communicate with the client as soon as reasonably possible.
8. Cancellations and Rescheduling
Clients are asked to provide at least 24 hours’ notice when cancelling or requesting to reschedule an appointment. No late-cancellation fee is charged. If a client misses an appointment without notice, Unique to You Colour will provide an opportunity to reschedule the appointment. Rescheduling is subject to availability.
9. Refunds for Services
Completed colour analysis services are generally non-refundable because the service is personalized and provided specifically for the client. Nothing in these Terms limits any refund, cancellation, or other rights that apply under applicable consumer protection law.
10. Returns and Refunds for Physical Products
Refund requests for physical products should be made within 30 days of receipt. Returned products must generally be unused, in their original condition and packaging, and accompanied by proof of purchase. Please contact Unique to You Colour before returning an item. Refunds will be processed after the returned item has been received and inspected. Original shipping charges are generally non-refundable except where required by law or where an item is damaged, defective, or incorrectly supplied.
11. Cosmetics
For health, hygiene, and safety reasons, opened or used cosmetics, including lipsticks and blushes, are not returnable except where required by applicable law or where the product is damaged, defective, or incorrectly supplied.
12. Damaged, Defective or Incorrect Products
If you receive a product that is damaged, defective, or different from the product ordered, please contact Unique to You Colour as soon as reasonably possible with details of the issue. We may request photographs or other information to assess the matter and will provide an appropriate remedy where required by law or these Terms.
13. Shipping and Delivery
Physical products may be shipped within Canada, to the United States, and internationally using shipping services selected by Unique to You Colour. Delivery estimates are provided as general estimates and may vary because of weekends, statutory holidays, customs, carrier delays, weather, and other circumstances outside our control.
Shipping charges are additional to product prices where applicable. International customers are responsible for any customs duties, import taxes, or other charges imposed by the destination country.
14. Product Availability and Pricing
Product availability and pricing may change without notice. Unique to You Colour reserves the right to correct pricing or product information errors and, where necessary, to reject or cancel an order. If an order is cancelled after payment has been processed, the amount paid for the cancelled order will be refunded.
15. Intellectual Property
All content published or made available on the Site, including text, images, logos, documents, downloadable files, graphics, product materials, and other content, is the property of Unique to You Colour or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, publish, or commercially exploit Site content without permission.
16. Client Photographs and Submitted Materials
Clients retain ownership of photographs and other materials they submit, subject to any rights necessary for Unique to You Colour to use those materials to provide the requested service. Client photographs submitted for online colour analysis will not be used publicly for marketing, social media, advertising, website content, or other promotional purposes without separate permission.
17. Website Use
You agree to use the Site lawfully and in a manner that does not interfere with its operation or compromise its security. You must not attempt to gain unauthorized access to the Site, its systems, or another user’s information, or use the Site for fraudulent, abusive, or unlawful purposes.
18. Third-Party Services and Payment Processors
The Site may use third-party providers for payment processing, shipping, website technology, analytics, communications, booking, or other functions. Third-party services may have their own terms and privacy policies. Unique to You Colour is not responsible for the independent practices of third-party providers except to the extent required by applicable law.
19. Disclaimer
Information and services provided by Unique to You Colour are intended for personal styling and colour guidance. While reasonable care is taken in providing products and services, no guarantee is made that information, product descriptions, photographs, online colour analysis results, or recommendations will be completely accurate or suitable for every individual circumstance.
20. Limitation of Liability
To the maximum extent permitted by applicable law, Unique to You Colour and its owners, officers, employees, contractors, agents, and service providers will not be liable for indirect, incidental, special, consequential, or punitive losses arising from use of the Site or products or services purchased through it. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
21. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Unique to You Colour and its owners, officers, employees, contractors, agents, and service providers from claims, losses, liabilities, costs, and reasonable expenses arising from your unlawful use of the Site, your violation of these Terms, or your infringement of another person’s rights.
22. Privacy
Personal information is handled in accordance with the Unique to You Colour Privacy Policy, as amended from time to time. The Privacy Policy explains what information may be collected, why it is collected, how it may be used or disclosed, and the rights and choices available to individuals.
23. Consumer Protection Laws
Where the Consumer Protection Act or any other applicable consumer protection legislation provides rights or remedies that cannot be excluded, these Terms do not limit those rights or remedies. These Terms will be interpreted subject to mandatory consumer protection requirements, and any mandatory legal provision will prevail where there is a conflict.
24. Changes to These Terms
Unique to You Colour may update these Terms from time to time to reflect changes to its services, Site, business practices, or legal requirements. The updated Terms will be posted on the Site with a revised effective or last-updated date. Where required by law, appropriate notice will be provided.
25. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or removed to the extent necessary, and the remaining provisions will continue in effect.
26. Governing Law
These Terms and Conditions are governed by the laws of the Province of Ontario and the applicable laws of Canada. Subject to mandatory consumer protection rights and other applicable law, disputes relating to these Terms or the Site will be subject to the applicable courts of Ontario.
